Standard Information Form for Package Travel Contracts
The offered combination of travel services is a package arrangement within the meaning of the Tourism Services Act.
The traveler therefore has all rights arising from the provisions of the Tourism Services Act relating to package arrangements. The travel agency FESHTA EVENTS d.o.o. is fully responsible for the proper performance of the package arrangement as a whole.
The travel agency FESHTA EVENTS d.o.o. has legally required insured guarantee for compensation of traveler payments and, if transport is included in the package arrangement, insurance for traveler repatriation in case it becomes insolvent.
Most Important Rights Under the Tourism Services Act
– Travelers will receive all essential information about the package arrangement before concluding the package travel contract.
– There is always at least one trader who is responsible for the proper performance of all travel services covered by the contract.
– Travelers receive an emergency phone number or contact point details through which they can contact the organizer or travel agency.
– Travelers can transfer the package arrangement to another person with reasonable notice and possible payment of additional costs.
– The price of the package arrangement can only be increased if specific costs increase (for example, fuel prices) and if this is explicitly provided for in the contract, and in any case no later than 20 days before the start of the package arrangement. If the price increase exceeds 8% of the package arrangement price, the traveler can terminate the contract. If the organizer reserves the right to increase the price, the traveler has the right to a price reduction if relevant costs decrease.
– Travelers can terminate the contract without paying any termination fee and receive a full refund of all payments if any essential element of the package arrangement is significantly changed except the price. If before the start of the package arrangement the trader responsible for the package arrangement cancels the package arrangement, travelers have the right to a refund and, if necessary, compensation.
– Travelers can terminate the contract without paying any termination fee before the start of the package arrangement in case of extraordinary circumstances, for example if there are serious security problems at the destination that could affect the package arrangement.
– In addition, travelers can at any time before the start of the package arrangement terminate the contract by paying an appropriate termination fee that can be justified.
– If after the start of the package arrangement significant elements of the package arrangement cannot be provided as agreed, alternative arrangements must be offered at no additional cost. If services are not provided in accordance with the contract and this significantly affects the performance of the package arrangement, and the organizer does not correct the non-compliance, travelers can terminate the package travel contract without paying a termination fee.
– Travelers have the right to a price reduction and/or compensation if travel services are not performed or if they are performed improperly.
– If the traveler encounters difficulties, the organizer must provide assistance.
– If the organizer, or in certain member states the seller, becomes insolvent, payment refund is ensured. If the organizer or, if necessary, the seller becomes insolvent after the start of the package arrangement and if transport is included in the package arrangement, traveler repatriation is ensured.
